These Terms & Conditions govern the use of our website and the provision of letting and property management services by Mustard Seed Estate & Letting Ltd (“we”, “us”, “our”) to landlords and, where applicable, tenants. By instructing us or using our website, you agree to be bound by these terms.
We offer three core service levels (Tenant Find, Rent Collection, and Full Management) as set out on our Services & Pricing page. The specific scope of work, fees and responsibilities for your instruction will be confirmed in a separate signed Terms of Business / Management Agreement between you and us, which takes precedence over general statements made on this website.
By instructing Mustard Seed Estate & Letting Ltd, you confirm that you have the legal right to let the property (including, where applicable, any necessary mortgage lender or leaseholder permission) and that all information you provide to us is accurate and complete.
Our fees are set out on our Services & Pricing page and confirmed in your signed agreement. Fees are payable as agreed and, where stated, are exclusive or inclusive of VAT as indicated. We reserve the right to review and update our fees from time to time, with reasonable notice given to existing clients.
Where we hold client money (such as rent or deposits) on your behalf, this is protected in accordance with a Client Money Protection scheme, as evidenced by our CMP certificate available in the footer of this website.
Either party may terminate an ongoing management instruction in accordance with the notice period set out in the signed agreement. Fees for work already carried out (such as a completed tenant find) remain payable even where an ongoing management instruction is subsequently cancelled.
Landlords are responsible for ensuring the property meets all relevant legal, safety and compliance requirements (such as gas safety, electrical safety and energy performance standards). Tenants are responsible for complying with the terms of their tenancy agreement, including rent payments and care of the property.
We will carry out our services with reasonable skill and care. We are not liable for losses arising from circumstances beyond our reasonable control, from inaccurate information provided by a client, or from the acts or omissions of third parties (such as contractors, referencing agencies or tenants), except where such liability cannot be excluded by law.
If you are unhappy with our service, please contact us directly so we can try to resolve the issue. If we are unable to resolve your complaint to your satisfaction, you may refer it to our redress scheme, The Property Redress Scheme, details of which are available in the footer of this website.
These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our services or website following any changes constitutes acceptance of the updated terms.
